The mission of the Office of Youth Tobacco Enforcement (OYTE) is to reduce the illegal sales of tobacco products to individuals under 21 years of age through effective enforcement of the Stop Tobacco Access to Kids Enforcement (STAKE) Act and to ensure flavored tobacco products are not being sold in California.

Job Description and Duties

THERE IS ONE VACANCY BEING ADVERTISED ACROSS MULTIPLE COUNTIES. THE INCUMBENT WILL BE HEADQUARTERED IN THE COUNTY NEAREST THE RESIDENCE OF THE SELECTED CANDIDATE. THE COUNTIES ARE:  *Fresno, Sacramento or Contra Costa *


This position supports the California Department of Public Health’s (CDPH) mission and strategic plan by promoting health and wellness and improving state health outcomes by advancing protective measures and reducing risks.

The Supervising Food and Drug Investigator supervises and trains staff to conduct extensive and complex investigations; initiates enforcement action to protect public health; oversees educational outreach; leads planning, evaluation, and quality improvement as part of a team; maintains technical proficiency; and works cooperatively with industry and government agencies.

This position is designated as peace officer under California Penal Code 830.3 (f) and (h). This position performs the full range of peace officer duties and responsibilities in the accomplishment of their assignments and must comply with the California Commission on Peace Officer Standards and Training (CA POST). During the course of their employment, incumbents are required to carry a firearm and be proficient in its use. They must also be knowledgeable in the use of force, and demonstrate appropriate application as prescribed in department policy.

The incumbent works under the general direction of the Chief, Food and Drug Unit (Unit Chief) in the Office of Youth Tobacco Enforcement (OYTE), Stop Tobacco Access to Kids Enforcement (STAKE) Unit – North.

Desirable Qualifications

In addition to evaluating each candidate's relative ability, as demonstrated by quality and breadth of experience, the following factors will provide the basis for competitively evaluating each candidate:




  • Demonstrate independent responsibility for decisions and actions with broad implications related to enforcing tobacco laws to protect public health.
  • Ability to work constructively with internal and external stakeholders.
  • Demonstrate ability to accurately analyze situations and take effective action.
  • Possess a valid and current POST certificate: Basic or Specialized Investigator Basic Certificate.
  • Experience in law enforcement and investigations.

Effectively manage multiple deadlines/assignments.

***Will also consider Temporary Authorization Utilization (TAU) appointments- Candidates that meet the minimum qualifications for the classification but do not currently have eligibility on an employment certification list by having taken and passed an examination may apply as a TAU. TAU appointments are limited to a duration of 9 months within a 12 consecutive month period. In order for a TAU appointment to become permanent, individuals must take and pass the related examination, and thereby become eligible from a certification list, within 9 months of TAU appointment. Individuals who successfully obtain eligibility prior to the expiration of the TAU appointment will not be required to re-compete in a competitive process for permanent appointment to that position.***
