Job Description

Location: Central Office – 123 Robert S. Kerr

Salary: up to $95,000.00, based on education and experience

Full Time /Part Time: Full Time

Work Schedule: Monday – Friday

Primary Hours: 8-5

Position Description:

The Assistant General Counsel II or III will be within the Office of the General Counsel handling a wide variety of legal issues for the Department’s administrative service areas and program areas.

Position Responsibilities/Essential Functions:

• Prepares briefs, pleadings, motions, petitions, and other legal documents.

• Reviews existing contracts, providing legal advice and counsel regarding the terms and conditions.

• Analyzes complex factual and legal issues and prepares legal opinions, memorandums of fact and law and other legal documents.

• Exercises responsibility for the development, preparation, and presentation of cases before administrative, state, federal, and appellate courts.

• Assists in drafting bills and amendments for legislative consideration, completes reports on changes in legislation, evaluates proposed legislation and makes recommendations for agency action in response thereto.

• Reviews and/or drafts proposed agency rules.

• Performs legal research and reports findings and conclusions.

• Advises on law, regulations, and opinions of the courts and those of the Attorney General; prepares or directs the preparation of interpretations outlining facts and the applicable legal, administrative, or executive decisions.

• Advises on questions of law or administrative policy involved in the operation of the agency and its contacts with industry, private or professional associations, state federal, or local government, and the general public.

• Provides legal guidance on HIPAA and related privacy laws, interpreting regulations and advising on compliance strategies.

• Reviews contracts, data or sharing agreements, and policies to ensure legal and regulatory compliance.

• Advises on risk mitigation for privacy and cybersecurity issues, ensuring legal obligations are met while protecting sensitive data.

• Role may include participation in governance committees.

Minimum Qualifications:

Level II:

Education and Experience requirements at this level consists of a Juris Doctor degree from an accredited law school, a license to practice law in State of Oklahoma, and membership in Oklahoma Bar Association and three or more years of legal experience.

An applicant may substitute up to two years of health law experience, litigation experience, or large entity in-house experience to meet the required experience. Current OSDH attorneys may additionally substitute experience by demonstrating the following:

• Executable specialized knowledge or experience applicable to job duties or ongoing needs of the division.

• The ability to work independently through completing job duties or projects with minimal oversight or direction.

• The ability to prioritize tasks based on client need or operational importance.

• Consistent quality work-product and timely client-communication; and

• The ability to meet agency and division-specific expectations regarding reporting, time entry, absences or leave.

Level III:

Education and Experience requirements at this level consists of a Juris Doctor degree from an accredited law school, a license to practice law in State of Oklahoma, and membership in Oklahoma Bar Association, and five or more years of legal experience.

An applicant may substitute up to three years of health law experience, litigation experience, or large entity in-house experience to meet the required experience. Current OSDH attorneys may additionally substitute experience by demonstrating the following:

• Executable specialized knowledge or experience applicable to job duties or ongoing needs of the division.

• The ability to work independently through completing job duties or projects with minimal oversight or direction.

• The ability to prioritize tasks based on client need or operational importance.

• Consistent quality work-product and timely client-communication; and

• The ability to meet agency and division-specific expectations regarding reporting, time entry, absences or leave.

• Applicants must be willing and able to perform all job-related travel normally associated with this position and possess a valid driver’s license.

Preferred Qualifications

Knowledge and understanding of data protection laws, such as HIPAA and related Federal and State privacy laws and regulations preferred.

Knowledge of legal principles and their application; of legal research methods; of the scope of Oklahoma statutory laws and provisions of the Oklahoma Constitution, of the United States Constitution, of the law and regulations on human resource management; of the principles of administrative law; of trial and hearing procedures and the rules of evidence.

Skill in directing and/or performing independent and difficult research; in analyzing, appraising and applying legal principles, facts and precedents to difficult legal or factual problems; in communicating effectively both orally and in writing; in presenting statements of fact, law, and argument clearly and logically in written or oral form; in presenting, explaining, or arguing cases to administrative commissions, boards, or courts; in dictating correspondence involving the explanation of difficult legal matters.

Physical Demands and Work Environment:

Work is typically performed in an office setting with climate-controlled settings and exposure to moderate noise levels. While performing the duties of the job, employees are required to talk, stand, walk, and reach with hands and arms.  This position requires long periods of sitting and daily use of computers and phones.  Employees must be willing to complete all job-related travel associated with this position.
