The NC Department of Health and Human Services (NCDHHS), Division of Public Health (DPH), Office of Regulatory and Legal Affairs is responsible for public health legal and regulatory support to NCDHHS and DPH leadership and staff, including the Assistant Secretary for Public Health and the State Health Director. RLA supports administrative rulemaking by the Commission for Public Health and State Registrar of Vital Statistics, provides legal consultation to state and local public health officials on public health issues, drafts, reviews and negotiates public health legal agreements, and administers the DPH Institutional Review Board (IRB).
 
The primary purpose of this position is to support the day-to-day responsibilities of the Office of Regulatory and Legal Affairs. The role includes negotiating, drafting, and reviewing legal agreements, drafting administrative rules and supporting the administrative rulemaking process, legal research and consultation on state and federal privacy requirements and a wide variety of public health legal issues, presenting information to internal and external stakeholders, and reviewing and responding to external requests, including data requests, public records requests, and other requests for records or information.

Knowledge, Skills and Abilities / Competencies

  • Working knowledge of relevant North Carolina and federal law, including statute, rule, case, and common law.

  • Proven experience in analyzing facts, evidence, and legal documents.
  • Experienced in drafting and negotiating legal documents.
  • Demonstrated experience using technology in fulfillment of assignments, including Microsoft Office Products, LexisNexis, and DocuSign.
Management Preferences:
Management strongly prefers a license to practice law in North Carolina, knowledge of or experience with public health law, programs, and processes, knowledge of or experience with the administrative rulemaking process in North Carolina, and knowledge of or experience with state and federal privacy laws.

Minimum Education and Experience Requirements

Juris Doctor from an appropriately accredited institution and two years of related professional legal or programmatic experience.
